Terms of Service

Effective Date: April 15, 2026

Welcome to What's Playin. These Terms of Service (“Terms”) govern your use of two products:

  • What's Playin — the mobile app for discovering music at venues.
  • What's Playin DJ (DJ Console) — the macOS app for DJs broadcasting their sets.

By downloading, accessing, or using either product, you agree to be bound by these Terms. If you do not agree, please do not use the products.

1. Eligibility

You must be at least 13 years of age to use the mobile app and at least 18 years of age to use DJ Console. By using either product, you represent that you meet the applicable age requirement.

2. Description of Service

What's Playin (Mobile App)

  • Identify songs currently playing at nearby venues and events.
  • Browse a live map of venues with active music.
  • View DJ set histories and follow DJs.
  • Explore track histories associated with venues.

What's Playin DJ (DJ Console)

  • Broadcast your live set tracks to assigned venues.
  • Maintain a public DJ profile with bio, photo, and socials.
  • View your set history.

We reserve the right to modify, suspend, or discontinue any part of either Service at any time without prior notice.

3. User Accounts

The mobile app may be used without an account for core features. DJ Console requires sign-in via Apple or Google to identify your DJ profile. You are responsible for maintaining the security of your sign-in credentials and for all activity under your account. Notify us immediately at [email protected] of any unauthorized use.

4. DJ Console — Additional Terms

Profile Approval

All DJ profiles are reviewed before becoming active. We reserve the right to deny or revoke profiles that misrepresent identity, violate these Terms, or fail to meet quality standards.

Venue Assignments

Venue assignments are currently created manually by our team based on information you provide. You are responsible for ensuring you are authorized to broadcast at the venue you are assigned to. Misuse may result in profile suspension.

Track Data

While broadcasting, the app reads song metadata (artist, title, timestamp) from your DJ software's history file and transmits it to our servers. No audio is captured or transmitted. You retain all rights to your set list.

Conduct

You may not impersonate other DJs, use offensive content in your profile, or use the platform to broadcast for venues you are not actually performing at.

5. Acceptable Use

You agree not to:

  • Use either product for any unlawful purpose or in violation of applicable laws.
  • Attempt to reverse-engineer, decompile, or derive the source code of either product.
  • Interfere with or disrupt servers or networks connected to the products.
  • Use automated systems (bots, scrapers) to access or collect data without express written permission.
  • Impersonate any person or entity, or misrepresent your affiliation with any person or entity.
  • Upload, transmit, or distribute content that is harmful, offensive, or infringes on the rights of others.

6. Intellectual Property

All content, features, and functionality of both products (including text, graphics, logos, icons, images, and software) are the property of What's Playin and its licensors and are protected by copyright, trademark, and other intellectual property laws.

Music metadata (song titles, artist names, album art) displayed in the app is sourced from third-party services and remains the property of the respective rights holders.

7. User Content

When you submit a DJ profile, set history, feedback, or other content, you grant us a non-exclusive, royalty-free, worldwide license to use, reproduce, and display such content for the purpose of operating and improving the products. You retain ownership of any content you submit.

8. Privacy

Your use of either product is governed by our Privacy Policy, which describes how we collect, use, and protect your information.

9. Disclaimers

The products are provided on an “as is” and “as available” basis without warranties of any kind, including:

  • Accuracy of song identification results.
  • Availability or accuracy of venue and DJ information.
  • Uninterrupted or error-free operation.
  • Reliability of DJ software integrations (VirtualDJ, Rekordbox, Serato).

Song recognition and DJ software integrations rely on third-party technology and may not always produce accurate results.

10. Limitation of Liability

To the maximum extent permitted by applicable law, What's Playin and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of either product.

11. Termination

We may suspend or terminate your access to either product at any time, with or without cause, and with or without notice. You may terminate your DJ Console account at any time from the app under Account Actions.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States. Any disputes shall be resolved in the courts of competent jurisdiction.

13. Changes to These Terms

We may update these Terms from time to time. When we do, we will revise the “Effective Date” at the top of this page. Your continued use of either product after any changes constitutes acceptance of the updated Terms.
